Linked is the Executive Order just issued by Governor Holcomb as well as FAQs.

I have quickly reviewed these materials this afternoon and see that there is a clear pattern.

  1. Paragraph #14, page 5 of the EO has the list of “Essential Businesses and Operations” – generally any business that wants to can find a way to determine that they are “Essential” (my opinion based on this wording)
  2. In the FAQs the following question is asked: What if I think my business should be closed, but they’re still asking me to report to work? Answer: "Essential businesses will remain open during the stay-at-home order to provide services that are vital to the lives of Hoosiers. If you believe your business is nonessential but still are being asked to show up to work, you may discuss it with your employer."  So you, as business owners, will have the ability to deem yourselves essential and there is no real way your employees can fight that – unless they go public (a possibility).

Many of you have work available to do. Others are busy adjusting operations to find a way to bring-in as much income as possible when you can’t avoid a closure. We should all be innovating like crazy to preserve our businesses, our livelihoods and the livelihoods of our employees. While I cannot speak for you, I would recommend that you interpret this order as liberally as is reasonable and stay open if at all possible. You may also wish to give your employees the option (recommended for liability and PR reasons) to work in your essential business.
